“The band plays no covers, and owns 100 percent of the publishing of the songs we’ve written. ASCAP has zero control, interests, or rights to our music.”

Considering that 99% of the bands playing Positive Force shows are underground punk bands releasing their own music it is also highly unlikely anyone else is registered with ASCAP. Anti-Flag might be since they have gotten sort of big but I doubt it.

There is a good chance that an artist that performed there in and around the time of the Even’s show logged the show on ASCAP plus or whatever their survey is called and then that made ASCAP aware of the fact that St Stephen’s was not paying a public performance license fee.

If you play copyrighted music you must pay. Are they not supposed to pay because they’re a church?

ASCAP and BMI send these to all sorts of places with live music and figure most of them will just pay up to avoid any possible future litigation even if they have zero evidence of anyone at the venue using the content they own.
